This policy explains what personal data we collect, why we collect it, how we look after it, and the rights you have over it. It applies to this website, peakcommercial.co.uk, and to the personal data we handle in the course of our work as a quantity surveying and commercial consultancy.
The data we collect
Through this website. When you contact us through the site, we collect the details you give us: typically your name, email address, telephone number, organisation and the content of your message. The website also collects limited technical data through cookies, described in our Cookie Policy, covering matters such as browser type, device and pages visited.
Through our work. When we are engaged by a client, we process the personal data reasonably necessary to deliver the engagement: names and business contact details of client personnel, counterparties and project teams, and personal data contained within project records, contracts and correspondence we are instructed to review.
Through recruitment. If you apply to work with us, we collect the information you provide in your application, such as your CV, qualifications and contact details.
We do not knowingly collect data from children, and our services are directed at businesses.
Why we use it and our lawful bases
We use personal data to respond to enquiries, deliver our services under contract, manage our client relationships, meet our legal and regulatory obligations, recruit, and run and improve this website. Under UK data protection law our lawful bases are: performance of a contract, where we are delivering services you or your organisation have engaged us for; legitimate interests, where we respond to enquiries, market our services to businesses and keep proper professional records, balanced against your rights; legal obligation, where the law requires us to keep records; and consent, where we ask for it, such as for non-essential cookies, which you can withdraw at any time.
We do not sell personal data, and we do not use personal data for automated decision-making that produces legal or similarly significant effects.
Who we share it with
We share personal data only where needed: with the providers who run our systems, including Wix.com Ltd, which hosts this website; with professional advisers such as accountants and insurers; with subconsultants engaged on a client matter, under appropriate obligations; and with regulators or authorities where the law requires. Where providers process data outside the UK, we rely on UK adequacy regulations or appropriate safeguards such as the UK International Data Transfer Agreement.
How long we keep it
We keep personal data only as long as it is needed. Enquiry data is kept while we deal with your enquiry and for a reasonable period afterwards. Client engagement records are kept for the duration of the engagement and afterwards in line with our professional, contractual and insurance obligations, retention period, 12 years for construction matters. Recruitment data for unsuccessful applications is kept for 6 months unless you agree to us holding it longer.
Your rights
You have the right to ask for access to your personal data, to have it corrected or erased, to restrict or object to its processing, to data portability, and to withdraw consent where consent is the basis. If you are unhappy with how we have handled your data, you can complain to the Information Commissioner's Office at ico.org.uk or on 0303 123 1113. We would welcome the chance to resolve your concern first.
Security
We apply proportionate technical and organisational measures to protect personal data, including access controls, encrypted hosting and staff confidentiality obligations. No transmission over the internet is completely secure, but we work to protect data to the standard our clients and the law expect.
