Commercial and NEC Contract Training

Commercial · NEC · Commercial Training

Most commercial problems on construction contracts are not caused by bad intentions. They are caused by people who did not know what the contract needed from them that week: the engineer who described a change in an email and thought that was notification, the site manager whose diary entries would not support a quotation, the commercial lead inheriting a compensation event register six months behind the works. Training exists to stop those problems being created, and it sticks when the people teaching it spend the rest of their week dealing with the consequences.

That is the basis of Peak Commercial's training. It is designed and delivered by the firm's directors, chartered quantity surveyors who administer NEC4 contracts, value compensation events, and act as party representative in adjudication and mediation on live UK infrastructure programmes. The examples come from delivery. The emphasis falls where accounts are actually won and lost, because the people delivering the training have closed those accounts.

Sessions are tailored to the team in front of us, not run from a fixed catalogue. Four subjects come up again and again. Commercial awareness for non-commercial staff, so engineers, site teams and project managers understand what the contract expects of them day to day. NEC4 contract practice, including the compensation event process, notification discipline and the records that make assessments stand up. Programme and cost interfaces, where commercial and planning teams lose each other. And dispute avoidance, drawing on the firm's party representative work to show teams what ends up in front of an adjudicator, and how the paperwork looked six months earlier.

Formats flex to the need. A half day for a site team, a structured series for a graduate cohort, or targeted sessions for a commercial team about to administer its first NEC4 target cost contract, all sit comfortably within the model.

Every session is led by a chartered director. James Fallon holds an MSc in Construction Law and Practice with Distinction alongside his BSc(Hons) and MRICS, with nineteen years across Tier 1 and Tier 2 contractors and current party representative practice in adjudication and mediation. Chris Turner holds BSc(Hons), MRICS, MCInstCES and MCIArb, with seventeen years leading commercial delivery on major highways and water programmes, and has published on NEC4 contract practice in the NEC Newsletter. Peak Commercial is regulated by RICS, and the standard of care that applies to the firm's commissions applies to its training.

This is the firm's own training, built from its delivery and dispute experience, and it carries no formal NEC or RICS accreditation. We say so plainly because teams booking training deserve to know exactly what they are buying: working knowledge from practitioners, tailored to their contracts and their people.
